Types of Probate in Florida

In Florida, there are primarily two types of probate proceedings:

  1. Formal Administration: This is typically used for larger estates or estates with complex assets. It involves court supervision and requires the appointment of a personal representative (executor) to administer the estate according to the terms of the will or Florida law.

  2. Summary Administration: This streamlined process is available for smaller estates (those valued at less than $75,000) or when the deceased person passed away more than two years ago. It is generally faster and less expensive than formal administration.
